While the government has declared the Islamic practice of triple talaq illegal, the custom shows no signs of abating
Khatima: Even after the Supreme Court struck down triple talaq calling it illegal and unconstitutional, the custom is very much prevalent and causing new problems. For instance, this recent happening in the Khatima district of Uttarakhand.
It all started when a couple, Juhi and Javed, faced marital problems after three years of marriage that resulted in a divorce in 2013. However, Javed had a change of heart after a few days and wanted to reconcile with Juhi.
But that was easier said than done as the Sharia custom of nikah halala requires a divorced woman to marry and sleep with another man in order to return to her first husband. So, the woman's relatives arranged for her to marry a 65-year-old man from Bareilly under the condition that he would divorce her soon so that she can be reunited with her first husband, Javed.
However, after the marriage, the older man refused to divorce Juhi alleging that since she had not consummated the marriage with him, he could not divorce her.
The family members responsible for carrying out the nikah halala are refusing to come forward to file a complaint fearing jail time.
While Javed and Juhi may be caught in a fix, but the couple's two children seem to be worst affected by this turn of events.
