Many have alleged that Kerala CPM state secretary Kodiyeri Balakrishnan’s son Binoy Vinodini Balakrishnan moved the Bombay high court to quash the FIR as an attempt to avoid providing samples of his DNA as directed by police.
Mumbai: Kerala CPM secretary Kodiyeri Balakrishnan’s son Binoy Vinodini Balakrishnan moved the Bombay high court to quash the FIR filed against him at Oshiwara Police Station in connection with the alleged rape of a former bar dancer. Binoy approached the court a day before he was required to appear before the investigation officer.
Mumbai Police registered an FIR against Binoy following a complaint by a 33-year-old former bar dancer, who claimed that Binoy had raped her on the fake promise of marrying her. Her complaint also stated that Binoy had been sexually assaulting her for over 10 years (2008-2018) and that she has an 8-year-old child of whom Binoy is the father.

The high court will consider the case on Wednesday. Binoy stated that the case was forged and added that there were contradictions in the woman's statement.
This move has lady many to speculate that Binoy has made this move to avoid the DNA test which the police have asked him to undergo. On July 8, Binoy had agreed to sampling of his blood for DNA testing.
However, he later failed to provide blood samples for the DNA test claiming that he was sick and requested that the sampling of his blood for DNA testing be postponed.

On July 3, the Mumbai Dindoshi sessions court granted anticipatory bail to Binoy. The court had granted Kodiyeri Balakrishnan's oldest son Binoy bail under strict conditions including, presenting himself before police officers every week for a month.
The accused was also required to pay a security deposit of Rs 25,000 and was not permitted to try to influence any witness, the court had remarked.
