The customs department, later, had lodged a complaint with the Kolkata police to file an FIR against the Banerjee couple and local police. Their complaint alleged that Rujira and Menka had not just refused to get their baggage checked, but also abused and threatened them with consequences.
The customs had also accused the local police of interfering and intimidating them on behalf of the TMC MP, who is also de facto second in command of the party after the chief minister.

The apex court told Mehta to file a separate application in the matter while the latter was arguing for the Central Bureau of Investigation (CBI) in the Saradha Chit Fund scam case pertaining to non-disclosure of call records to the premier agency by cellular service providers Airtel and Vodafone. The matter also pertains to former Kolkata police commissioner Rajiv Kumara and how he allegedly botched up the investigation into the scam.
While arguing, Mehta had alleged that there was law and order crisis in West Bengal and mentioned how Mamata Banerjee’s nephew Abhishek’s wife was caught with gold at the Kolkata airport. He also mentioned that the local police were alleged to have interfered in the matter to pressurise the customs officials to release Rujira without any checks.
In response to this, Chief Justice of India Ranjan Gogoi told Mehta to move a separate application in the matter.
