Patiala court says hang Nirbhaya rapists on March 3, but will there be another legal red herring?

A new date has been issued by the Patiala court to hang the four Nirbhaya rapists. The date is March 3 and the time is 6am. Nirbhaya’s mother is hopeful that this time at least, there won’t be any legal red herrings for the hanging to take place.

Bengaluru: After two procrastinations, the Patiala court has issued fresh hanging date for the four Nirbhaya rapists. 

The new date is March 3 and the time is 6am. 

A petition in this regard was filed by the state and Nirbhaya's parents.

It might be recalled that the Delhi high court on February 5 granted a week's time to the four convicts to avail all legal remedies and said that the convicts cannot be hanged separately since they were convicted for the same crime.

A Delhi court had issued a death warrant against the four convicts Vinay Sharma, Akshay Thakur, Pawan Gupta, and Mukesh Singh on January 7 and they were scheduled to be executed on January 22 at Tihar Jail. The execution which was pushed to February 1 was then suspended indefinitely by a Delhi court. 

While all the other convicts have now exhausted their legal remedies, Pawan Gupta can really play spoilsport as he can potentially cause a change in judgment as he can still file a curative plea as well as a mercy petition before the president.

The court was informed that another death row convict Vinay was assaulted in jail and has suffered head injuries. The court was also told that he was suffering from acute mental illness and hence the death sentence cannot be carried out.

Based on what the lawyer said, the court directed the Tihar jail superintendent to take appropriate care of Vinay as per law.

Nirbhaya’s mother said, “I am not very happy as this is the third time that death warrant has been issued. We have struggled so much, so I am satisfied that death warrant has been issued finally. I hope they (convicts) will be executed on March 3.” 

Nirbhaya’s father also hoped that there won’t be any further delay.
