HD Ramesh, Deve Gowda’s son, bought 5.38 acres of land from Nanjundaiah. But records show that he owned just 4.12 acres of land and 1.26 acres of government land was illegally acquired by Ramesh.
Bengaluru: A complaint has been filed by TJ Abraham, president of the Karnataka anti-graft environmental forum alleging that former PM HD Deve Gowda's son HD Ramesh had illegally grabbed 1.26 acres of government land.
Cases have been filed under sections 4 and 5 of Karnataka Land Grabbing Act 2011, sections 5 and 6 of Karnataka Public Premises (Eviction of Unauthorised Occupants) Act 1974, 192-A, 192-B, 192-C, of the Karnataka Land Revenue Act 1964 and section120 B and 420 of the Indian Penal Code.
The complaint has also been issued against DC Nanjundaiah, who sold the land to HD Ramesh, Sri Sai Developers, who bought the land from HD Ramesh and also Mitravinda Trust, who bought the land from Sai Developers.
It is alleged that Nanjundaiah, who sold the land to Ramesh, owned only 4.12 acres of land legally, but when it was sold to HD Ramesh, the sale deed was made for 5.38 acres without any additional documents for the remaining 1.26 acres of land.
A portion of government land situated in Survey no 116 Ballur Village Attibele Hobli, Anekal taluk Bengaluru urban district, was granted to three different persons - Muthappa, Venkataramanappa and Srinivasareddy under Land Tribunal Anekal Taluk of the Karnataka Land Reforms Act 1961.
The land was granted Muthappa on June 26, 1981, to Venkataramanappa on November 17, 1981, and to Srinivasareddy on November 10, 1981.
Thus, according to records, Muthappa and his heirs enjoyed 25 guntas of land and Venkataramanappa and his heirs enjoyed the ownership of 3 acres 26 guntas of land. Srinivasareddy owned 1 gunta of land in survey number 116. This land totalling up to 4 acres 12 guntas was bought by Nanjundaiah.
A sale deed was signed between HD Ramesh and Nanjundaiah on May 6, 2005. In this sale deed, instead of 4 acres 12 guntas of land he owned, Nanjundaiah was made to sign a fraudulent claim of an additional 1 acre 12 guntas of land in the survey number 116, that he did not own. The registration was made for 5.38 acres of land at office of sub-registrar Basavanagudi (Anekal), Bengaluru for Rs 24,11,250.
Interestingly, the land measuring 1 acre and 12 guntas in the survey number 116 was never discussed before registering of the sale deed on July 6, 2013.
Currently, the value of 1 acre 12 guntas land that was illegally acquired is Rs 11,78,94,000.
On May 2, 2012, Ramesh made two separate applications separately for 4.26 acres and 1.26 acres of land. The district commissioner accepted the applications and signed the same. Thus, HD Ramesh issued two official memorandums dated May 25, 2012 and July 30, 2012 converting the said agricultural property to residential purpose. Then, through a sale deed, 5.38 acre land was sold to Sri Sai Developers for a sales consideration of Rs 2,67,75,000 at the sub-registrar's office, Basavanagudi (Attibele) on August 21, 2012.
When it was sold to Sai Developers, it was mentioned that complete land of 5.38 guntas belonged to Nanjundaiah and HD Ramesh bought the land from him.
Sai Developers sold the land to Mitravinda Trust on July 6, 2013 through a sale deed. Interestingly, the 1.26 acres that was never discussed in the earlier documents separately is mentioned in this deed separately that 1.26 acres of Scheduled Property was owned by Nanjundaiah.
The fact remains that the irregularity was noted when the land was first sold to HD Ramesh. Would a former Prime Minister's son buy a land without proper documents, or was he involved in adding the 1.26 acres of government land illegally.
The complainant has demanded initiation of proceedings against the accused under the civil and criminal law.
